When ever an FCC licensee / permittee submits application for a
license or a construction permit the applicant is required to submit FCC
Form 323-E ownership reports stating information which includes
information about the address of each director. On December 15, 2014 the
FCC denied KBOO s petition for reconsideration of an August 25, 2014,
letter decision as to the part where an applicant is required to list a
residence address for each director based on 47 CFR Rule 73.3615 which
requires that:
ownership reports for noncommercial educational ("NCE") stations include,
among other things, the "[n]ame, residence, office held, citizenship,
principal profession or occupation, and by whom appointed or elected" for
each board member.
The August decision required the KBOO Foundation to amend its current
ownership report ... and all subsequent ownership reports.
The Foundation petitioned for reconsideration because:
as a general policy matter, there are very real privacy and safety
concerns implicated by requiring the use of private residential addresses
for board members.
It informed te FCC that:
For purposes of privacy and to avoid the stalking of board members, KBOO
in recent years has used its corporate address for board members except
where specifically required by the FCC's application.
The KBOO Foundation has decided not to challenge the residence
address requiement.
This leaves other NCE stations with the possible need to adjust
their ownership reports. for example in 2006 the Pacifica ownership report
appears to list the home residence for each director, while my samples for
2011 and later list only the corporate address in Berkeley. See
