Tim,
A nonprofit consists of two things, its membership if it is
membership--based and its board of directors. That is the legal structure.
That is what Pacifica consists of. That is who owns the license. So how did
Pacifica the legal entity make this decision when there was no notification
to the board of directors, including all 4 of them elected by the members
to represent the WBAI signal area in question.
The judge invoked the NY nonprofit code Section 1315 which does in fact
grant authority to the Supreme Court of New York to regulate the activities
of a foreign corporation regarding their business activities in NY state,
NY is very aggressive in regulating out of state entities.
This is not in front of the FCC, so that's irrelevant.
